1. Tento dokument obsahuje informácie o tom ako spoločnosť Integrovaná doprava Žilinského a Trenčianskeho kraja, s. r. o. so sídlom Pri Rajčianke 2900/43, 010 01 Žilina, IČO: 51 110 369, DIČ: 212 059 0252, zapísaná v obchodnom registri Okresného súdu Žilina, Oddiel: Sro, Vložka číslo: 68560/L (ďalej len Prevádzkovateľ) spracúva osobné údaje získané od každej fyzickej osoby (ďalej len Používateľ), ktorá využíva produkty a služby prostredníctvom mobilnej aplikácie s názvom „IDS PLUS“ (ďalej len MA IDS PLUS).
2. Ochrana osobných údajov a spracúvanie osobných údajov sa riadi Nariadením európskeho parlamentu a rady (EÚ) 2016/679 z 27. apríla 2016 o ochrane fyzických osôb pri spracúvaní osobných údajov a o voľnom pohybe takýchto údajov, ktorým sa zrušuje smernica 95/46/ES (všeobecné nariadenie o ochrane údajov) a na základe ustanovení zákona č. 18/2018 Z. z. o ochrane osobných údajov a o zmene a doplnení niektorých zákonov (ďalej len ako „zákon”), vám ako dotknutej osobe oznamujeme nasledovné informácie o spracúvaní vašich osobných údajov v súvislosti s vašou registráciou v MA IDS PLUS.
3. Pri registrácii Používateľa a využívaní služieb spojených s nákupom cestovného lístka MA IDS PLUS je Používateľ povinný poskytnúť nasledujúce osobné údaje:
a. meno, priezvisko;
b. e-mailová adresa;
c. ak má Používateľ menej ako 16 rokov, tak aj osobné údaje jeho zákonného zástupcu v rozsahu: meno, priezvisko, dátum narodenia, adresa trvalého pobytu a e-mailová adresa.
4. Pre nákup predplatných cestovných lístkov, ktoré sú v zmysle Prepravného poriadku IDS PLUS neprenosné a vydávané len na meno, je v MA IDS PLUS potrebná rozšírená registrácia. Pri rozšírenej registrácii je Používateľ naviac povinný poskytnúť:
a. dátum narodenia;
b. adresa trvalého pobytu;
c. fotografiu svojej tváre v elektronickej forme;
d. kópiu svojho dokladu totožnosti v elektronickej forme ak Používateľ žiada o rozšírenú registráciu s jednou zo zľavnených tarifných skupín;
e. kópiu preukazov nároku na zľavu podľa Prepravného poriadku IDS PLUS ak Používateľ žiada o rozšírenú registráciu s jednou zo zľavnených tarifných skupín.
5. Prevádzkovateľ získané osobné údaje Používateľa nezverejňuje ani neposkytuje iným osobám, s výnimkou prípadov, kedy mu túto povinnosť ukladá všeobecný právny predpis alebo v osobitných prípadoch so súhlasom dotknutej osoby, ktorej sa osobné údaje týkajú.
6. Platnosť každého profilu v rozšírenej registrácii je časovo ohraničená. Po skončení platnosti je potrebné registráciu obnoviť.
7. Kópie dokladov vymenovaných v bodoch 3 a 4 slúžia na overenie zadaných údajov a zabezpečenie adresnosti poskytovaných zliav na cestovnom a pre možnosť vydávania duplikátov predplatných cestovných lístkov. Po schválení alebo zamietnutí žiadosti dôjde k nezvratnému vymazaniu všetkých kópií dokladov.
8. Ak má Používateľ menej ako 16 rokov, takéto spracúvanie osobných údajov je zákonné iba ak súhlas so spracúvaním osobných údajov poskytol alebo schválil jeho zákonný zástupca. Používateľ je povinný uviesť úplné a pravdivé osobné údaje.
9. Používateľ svojou registráciou potvrdzuje, že súhlasí so Všeobecnými obchodnými podmienkami používania mobilnej aplikácie IDS PLUS a so spracúvaním, správou a uchovaním vyššie uvedených a poskytnutých osobných údajov v súvislosti s registráciou v MA PLUS a jej používaním.
10. Prevádzkovateľ prijal primerané technické, organizačné opatrenia zodpovedajúce spôsobu a účelu spracúvania osobných údajov, pričom zobral do úvahy najmä použiteľné technické prostriedky, dôvernosť a dôležitosť spracúvaných osobných údajov, ako aj rozsah možných rizík, ktoré sú schopné narušiť bezpečnosť alebo funkčnosť informačného systému.
11. Používateľ má právo získať od Prevádzkovateľa potvrdenie o tom či sa o ňom spracúvajú osobné údaje. Ak Prevádzkovateľ takéto osobné údaje spracúva, Používateľ má právo na prístup k týmto svojim osobným údajom a na informácie o:
a. účele spracúvania osobných údajov;
b. kategórii spracúvaných osobných údajov;
c. identifikácii príjemcu alebo o kategórii príjemcu, ktorému boli alebo majú byť osobné údaje poskytnuté, najmä o príjemcovi v tretej krajine alebo o medzinárodnej organizácií, ak je to možné;
d. dobe uchovávania osobných údajov alebo ak to nie je možné tak informáciu o kritériách jej určenia;
e. práve požadovať od Prevádzkovateľa opravu osobných údajov týkajúcich sa dotknutej osoby, ich vymazanie alebo obmedzenie ich spracúvania, alebo o práve namietať spracúvanie osobných údajov;
f. práve podať návrh na začatie konania;
g. zdroji osobných údajov ak sa osobné údaje nezískali od Prevádzkovateľa;
h. existencii automatizovaného individuálneho rozhodovania vrátane profilovania pričom v týchto prípadoch poskytne Prevádzkovateľ Používateľovi informácie najmä o použitom postupe, ako aj o význame a predpokladaných dôsledkoch takéhoto spracúvania osobných údajov pre dotknutú osobu.
Ak bude Používateľ opakovane požadovať poskytnutie osobných údajov v tom istom rozsahu, môže mu Prevádzkovateľ účtovať primeraný poplatok zodpovedajúci administratívnym nákladom.
12. Ak sa Používateľ domnieva, že akékoľvek jeho osobné údaje, ktoré Prevádzkovateľ spracúva, sú nesprávne alebo neúplné, tak môže požiadať Prevádzkovateľa o sprístupnenie týchto informácií, opravu alebo o ich vymazanie. Požiadavku na prístup k osobným údajom je možné vybavovať niektorou z nasledujúcich metód:
a. e-mailom na adresu: dpo@idsplus.sk
b. poštou na adresu sídla spoločnosti Integrovaná doprava Žilinského a Trenčianskeho kraja, s. r. o.: Pri Rajčianke 2900/43, 010 01 Žilina.
13. Aby bol Prevádzkovateľ schopný odpovedať na žiadosť o prístup k osobným údajom, tak Používateľ musí poskytnúť Prevádzkovateľovi dostatočné informácie na overenie svojej totožnosti (aby sa zabezpečilo, že osoba, ktorá požaduje informácie, je Používateľom alebo jeho právnym zástupcom).
14. V prípade, ak chce Používateľ podať sťažnosť na to, ako Prevádzkovateľ spracúva jeho osobné údaje, obráti sa na poverenú Zodpovednú osobu (Data Protection Officer - DPO) Prevádzkovateľa, ktorej adresa je dpo@idsplus.sk, alebo písomne na adresu sídla spoločnosti Integrovaná doprava Žilinského a Trenčianskeho kraja, s. r. o.: Pri Rajčianke 2900/43, 010 01 Žilina. Zodpovedná osoba potom preskúma sťažnosť a bude s Používateľom spolupracovať pri vyriešení sťažnosti. Ak používateľ aj naďalej zastáva názor, že jeho osobné údaje neboli riadne spracúvané v zmysle zákona č. 18/2018 Z. z. o ochrane osobných údajov a o zmene a doplnení niektorých zákonov, môže sa obrátiť na Úrad na ochranu osobných údajov.

1. This document contains information on how the company Integrovaná doprava Žilinského a Trenčianskeho kraja, s. r. o., with its registered office at Pri Rajčianke 2900/43, 010 01 Žilina, ID No.: 51 110 369, Tax ID No.: 212 059 0252, registered in the Commercial Register of the District Court Žilina, Section: Sro, Insert No.: 68560/L (hereinafter referred to as the Controller) processes personal data obtained from each natural person (hereinafter referred to as the User), which uses products and services through a mobile application called 'IDS PLUS' ('MA IDS PLUS').
2. The protection of personal data and the processing of personal data is governed by Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, repealing Directive 95/46/EC (General Data Protection Regulation) and on the basis of the provisions of Act No. 18/2018 Coll. on the protection of personal data and on amendments to certain acts (hereinafter referred to as the "Act"), We would like to inform you, as the data subject, of the following information about the processing of your personal data in connection with your registration in MA IDS PLUS.
3. When registering the User and using the services associated with the purchase of the MA IDS PLUS ticket, the User is obliged to provide the following personal data:
a. name, surname;
b. email address;
c. if the User is under 16 years of age, then the personal data of his/her legal representative in the following scope: name, surname, date of birth, permanent residence address and e-mail address.
4. For the purchase of prepaid tickets, which are non-transferable in accordance with the IDS PLUS Transport Regulations and issued only in the name of the IDS PLUS Transport Regulations, extended registration is required in the IDS Plus Transport Regulations. In the case of extended registration, the User is also obliged to provide:
a. date of birth;
b. permanent residence address;
c. a photograph of their face in electronic form;
d. a copy of his/her identity document in electronic form if the User applies for extended registration with one of the discounted tariff groups;
e. a copy of the cards entitled to a discount according to the IDS PLUS Transport Regulations if the User applies for extended registration with one of the discounted tariff groups.
5. The Operator does not disclose or provide the User's personal data to other persons, except in cases where this obligation is imposed on him by a general legal regulation or in special cases with the consent of the data subject to whom the personal data relates.
6. Each profile in the extended registration is valid for a limited time. Once it has expired, the registration must be renewed.
7. Copies of the documents listed in points 3 and 4 are used to verify the entered data and ensure the addressability of the discounts provided on fares and for the possibility of issuing duplicates of prepaid tickets. Once the application is approved or rejected, all copies of the documents will be irreversibly deleted.
8. If the User is under 16 years of age, such processing of personal data is lawful only if the consent to the processing of personal data has been given or approved by his/her legal representative. The User is obliged to provide complete and truthful personal data.
9. By registering, the User confirms that they agree with the General Terms and Conditions of Use of the IDS PLUS Mobile Application and with the processing, management and storage of the above-mentioned and provided personal data in connection with the registration in MA PLUS and its use.
10. The Controller has taken appropriate technical and organisational measures appropriate to the manner and purpose of the processing of personal data, taking into account, in particular, the applicable technical means, the confidentiality and importance of the personal data processed, as well as the scope of possible risks that are capable of disrupting the security or functionality of the information system.
11. The User has the right to obtain confirmation from the Controller as to whether personal data about him or her is being processed. If the Controller processes such personal data, the User has the right to access their personal data and to information about:
a. the purpose of the processing of personal data;
b. the category of personal data processed;
c. the identification of the recipient or the category of recipient to whom the personal data have been or are to be disclosed, in particular the recipient in a third country or an international organisation, where possible;
d. the period of storage of personal data or, if this is not possible, information on the criteria for its determination;
e. the right to request from the Controller the rectification of personal data relating to the data subject, their deletion or restriction of their processing, or the right to object to the processing of personal data;
f. the right to initiate proceedings;
g. the source of personal data, if the personal data were not obtained from the Controller;
h. the existence of automated individual decision-making, including profiling, whereby in these cases the Operator shall provide the User with information, in particular, about the procedure used, as well as about the significance and anticipated consequences of such processing of personal data for the data subject.
If the User repeatedly requests the provision of personal data to the same extent, the Operator may charge him a reasonable fee corresponding to the administrative costs.
12. If the User believes that any of their personal data processed by the Controller are incorrect or incomplete, they may request the Controller to make this information available, correct or delete it. A request for access to personal data can be handled by one of the following methods:
a. by e-mail to: dpo@idsplus.sk
b. by post to the address of the registered office of the company Integrovaná doprava Žilinského a Trenčianskeho kraja, s. r. o.: Pri Rajčianke 2900/43, 010 01 Žilina.
13. In order for the Controller to be able to respond to a request for access to personal data, the User must provide the Controller with sufficient information to verify his/her identity (to ensure that the person requesting the information is the User or his/her legal representative).
14. If the User wishes to file a complaint about how the Controller processes their personal data, they shall contact the Data Protection Officer (DPO) of the Controller, whose address is dpo@idsplus.sk, or in writing to the address of the registered office of the company Integrovaná doprava Žilinského a Trenčianskeho kraja, s. r. o.: Pri Rajčianke 2900/43, 010 01 Žilina. The Data Protection Officer will then investigate the complaint and cooperate with the User in resolving the complaint. If the user continues to be of the opinion that their personal data have not been properly processed in accordance with Act No. 18/2018 Coll. on the Protection of Personal Data and on Amendments to Certain Acts, they may contact the Office for Personal Data Protection.
